Insurance for Modified Exhausts: Legal vs. Illegal Upgrades

Malaysian car culture is vibrant, but a modified exhaust can turn your pride and joy into a legal liability. JPJ has been stepping up enforcement against illegal vehicle modifications — in mid-2026, it signalled a tougher approach of taking extreme cases straight to prosecution, on top of its existing power under Section 64 of the Road Transport Act 1987 to seize vehicles that violate the Act. For an insurance claim to be valid, your car generally needs to stay road-legal.

The VTA (Vehicle Type Approval) Standard

Every car sold in Malaysia has a Vehicle Type Approval (VTA) — JPJ's certification that the vehicle complies with Malaysian laws, regulations and standards for use on public roads. Any change to the exhaust system that alters backpressure, noise, or emissions beyond what's approved in the VTA is a violation.

For a standard passenger car (up to 9 seats, including the driver), the legal noise limit is 80 dB(A) under the Environmental Quality (Motor Vehicle Noise) Regulations 1987 — enforced by the Department of Environment, separately from JPJ's own VTA compliance checks.

If your modification isn't JPJ-approved, your insurer may dispute or reduce a claim on the grounds that the vehicle wasn't in its approved condition at the time of the accident.

Declare, Don't Hide

Even a legal, mild upgrade should be declared. For example, if you spend RM5,000 on a high-end exhaust and don't list it as an "Accessory" on your policy, your insurer may only pay out for a standard stock exhaust if it's damaged.

Frequently Asked Questions:

1. Will a modified exhaust void my insurance?

It can, if it's illegal or undeclared. Always inform your insurer about any changes to your car's factory specifications.

2. What modifications are legal in Malaysia?

Generally, minor aesthetic changes (spoilers, side skirts) are fine. Any change to the engine, exhaust, or structural integrity usually needs JPJ approval.

3. Does a louder exhaust increase my premium?

Not necessarily, but it may change your coverage terms. Some insurers may decline to cover specialised aftermarket parts unless they're specifically added to the policy.

4. Can JPJ seize my car for a modified exhaust?

Under Section 64 of the Road Transport Act 1987, JPJ can seize a vehicle to prevent continued use of an illegal modification until it's rectified.
